Thats terrible. Although cant accurately guess the speed your dog did run out into the road in front of traffic so a court would find them not at fault. I have a shock collar on mine with the range set to 15 feet before the road. The brand is pet safe and has worked really well. Did your dog survive? I think it would be the only thing you can do. 
Sorry for your loss… Don’t leave your dog out, if you do, teach him boundaries or install a invisible fence collar…
